- Decision of the Supreme Court of 15th March 1999: an environmental NGO challenged the art. 13.2 of Royal Decree 1997/1995, for not having included in its Annex II the «Canis Lupus» species living in the southern habitats of the Duero River. The Supreme Court stated that the provision challenged was not a derogation allowed by the Habitats Directive, and annulled it.
- Decision of the Supreme Court of
5th March 2001: two environmental NGOs «EKI» and «Eguzkizaleak» and the
State Administration challenged the Regulation of the Basque Department of
Agriculture of 14th January 1992, that permitted the hunting of «columba
palumbus» during the migration of this species to its breeding area, and
enlarged the hunting period established as under art. 7.4 of the Birds
Directive. The Court stated that the Basque Regulation did not comply to the EC
Law, insofar the Basque Administration held the power to determine the concrete
dates for the hunting periods, provided that the hunting is not allowed during
the rearing periods. Furthermore, the derogation of the Basque regulation did
not even specify the means, arrangements, conditions, circumstances, controls or
methods authorized for capture or killing, as under art. 9.1 c) of the Birds
Directive. An identical case to the latter was the subject of the Decision of
the Supreme Court of 21st May 2001, regarding the same Basque regulation issued
for the hunting season of 1994.
- The Aragonese Court of
Justice has adopted a recent decision on 5th April 2005 regarding the
geographical scope of the SPAs. In this case, an environmental NGO «Asociación
Plataforma Jalón Vivo» challenged the delimitation of a SPA made by the
Autonomous Administration of Aragon, and simultaneously lodged a complaint with
the European Commission because they considered that the perimeter delimitated
did not comply with IBA 93 (Hoces del Jalón). The Commission decided that not
further action should be taken during the national lawsuit, but this fact did
not affect the issue. The Court stated that the Aragonese Administration had not
motivated with ornithological criteria the restriction of the perimeter of the
SPA. Furthermore, the Court obliged the Autonomous Administration to issue a new
delimitation of the SPA identical to the IBA 93. This decision has been appealed
before the Supreme Court.
